1. About these Terms
These Terms govern use of Need2Check. The app is provided by Zsombor Varkonyi, Hungary (“we”, “us” or “our”). Contact: [email protected]. By using the app, you agree to these Terms. Need2Check is intended primarily for private individuals, including buyers, sellers, tenants, landlords and property owners, but may also be used by professionals.
2. Purpose
Need2Check is an inspection-assistance and documentation tool. It is not a professional engineering, architectural, building-surveying, valuation, legal or other specialist service, and does not replace a qualified professional.
3. Free allowance and Professional
The app includes an initial allowance of five inspections (“Free Allowance”), counted from first use of inspection functionality, not from account registration or subscription purchase. Further inspections require an active Professional subscription. Professional may provide additional features, including report email.
If a subscription expires or is cancelled, existing inspections remain accessible and are not deleted merely because the subscription ends. The five-inspection Free Allowance remains available, while further inspections beyond it require active Professional. We may change features subject to applicable law.
4. Account
Certain Professional features require an account. Provide accurate information, keep credentials secure and prevent unauthorised account use. You must have legal capacity to enter into the applicable agreement, or use the app with parent/guardian involvement and consent where required by law.
5. Subscription, Google Play and consumer rights
Professional is a recurring subscription purchased through Google Play. Google Play handles payment, billing, renewal, cancellation and refund processes under its applicable terms. We do not independently process subscription payments or refunds. Manage your subscription through the Google Play account used to purchase it.
Deleting your Need2Check account does not cancel your Google Play subscription. Cancel separately through Google Play to prevent future renewals.
Nothing in these Terms excludes or unlawfully restricts mandatory consumer rights. Statutory withdrawal or cancellation rights remain subject to the conditions and exceptions established by applicable law. Special rules may apply when digital-service performance begins during a withdrawal period, including requirements for an express request or acknowledgement. Google Play’s applicable purchase process and terms also apply.
6. Inspection data, photos and user content
You retain ownership of inspection information, photos, notes and other content you create or add (“User Content”). We do not acquire ownership. Content is primarily stored locally, and you are responsible for managing and backing it up. You grant us only the limited rights needed to provide a feature you request, such as report email.
You are responsible for ensuring User Content is lawful and does not infringe others’ rights or violate privacy/data-protection law. You must have any required permissions or legal basis to record or share information about other people.
7. PDF reports and email
PDF reports are generated on your device. Professional users may request email delivery to the email address registered to their Need2Check account. Third-party infrastructure is used and delivery is not guaranteed. We do not retain a copy merely because it was emailed. If the app or device cannot share or send the file, we may be unable to retrieve or resend it; you may need to share it manually from your device.
8. Acceptable use
You must not use the app to violate law or another person’s rights; infringe intellectual-property or privacy rights; engage in fraudulent, deceptive or abusive activity; bypass subscription requirements or access controls; interfere with app operation or security; or attempt unauthorised access to systems or data.
9. Intellectual property
We and/or our licensors retain intellectual-property rights in the app, software, interface, branding, logos, text, graphics, report templates, taxonomy and other materials, except User Content. You receive a limited, non-exclusive, non-transferable right to use the app for its intended purpose. Except as permitted by law, you must not copy, modify, distribute, sell, sublicense, reverse engineer or otherwise exploit the app or its materials.
10. Availability and changes
The app is provided on an “as available” basis. We may update, modify, suspend or discontinue the app or features for technical, operational, security, legal or business reasons. Uninterrupted, error-free or unchanged availability is not guaranteed. Where reasonably practicable, we will notify users of significant planned changes. Mandatory consumer rights are unaffected.
11. Third-party services
The app may rely on Google Play, RevenueCat, Firebase and Resend. Their own terms and policies may apply. To the maximum extent permitted by law, we are not responsible for failures caused by third-party services outside our reasonable control.
12. Inspection disclaimer
Need2Check provides tools for recording observations. We do not inspect properties for you and do not verify or guarantee the accuracy, completeness, reliability or technical correctness of observations, findings, measurements, photos or reports. The app does not guarantee property condition, quality, safety, value, legal compliance or suitability. You are responsible for your assessments and decisions and should seek qualified professional advice where appropriate.
13. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, or loss arising from reliance on inspection information/reports or third-party service failures outside our reasonable control. Nothing excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
14. Suspension and termination
We may suspend or terminate access where reasonably necessary due to material breach, unlawful or abusive use, attempts to circumvent access/subscription requirements, security risk or legal requirements. Where appropriate, we will allow an opportunity to remedy the issue; we may act immediately to address serious risks or comply with law. Termination does not cancel a Google Play subscription.
15. Account deletion
You may delete your account through the in-app function. Account deletion does not cancel a Google Play subscription; cancel it separately. Local inspections, photos and reports are separate from your account and may remain on your device until deleted, app data is cleared or the app is uninstalled.
16. Privacy
The Privacy Policy forms part of the legal framework for using Need2Check and explains personal-data processing. If these Terms conflict with the Privacy Policy on personal-data processing, the Privacy Policy controls for that matter.
17. Changes to Terms
We may update these Terms. The current version will be published here. Where legally permitted, continued use after updated Terms take effect constitutes acceptance.
18. Governing law and disputes
Hungarian law governs these Terms, without prejudice to mandatory consumer-protection rights in your country of residence. Please contact us first to try to resolve concerns directly. Court proceedings will be brought before competent courts under applicable law, preserving mandatory consumer jurisdiction rights.
19. Events beyond reasonable control
We are not responsible for delay or failure caused by events beyond our reasonable control, to the extent permitted by law.
